Centre plans to decriminalise provisions of LLP Act, invites comments

The ministry, which is employing the LLP Act, has sought comments from stakeholders on the proposed improvements by July four.

It has been resolved to evaluate the penal provisions of the Act to decriminalise compoundable offences involving slight, procedural or complex violations. Offences that may well not require any harm to community curiosity would also be reviewed, according to the ministry.

Sandeep Jhunjhunwala, associate at Nangia Andersen LLP, mentioned the ministry would seem to be arranging for an overhaul of penal provisions relevant for submitting or reporting non-compliances by the partners of constrained liability partnership companies, which do not require considerable violations or are not opposite to the larger community curiosity.

LLP Act has 81 sections and four schedules.

The ministry has now decriminalised numerous offences less than the Companies Act, 2013.
